Family Visa - Child Migration - Adoption

Can you apply?
  1. The adopted child must be under 18 at both the visa application date and the visa decision date.
  2. The adopted child must either have been, or be in the process of being, adopted.
  3. The adopted child must be sponsored by either an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
  4. If the child was adopted before the sponsor became an Australian citizen, Australian permanent resident or eligible New Zealand citizen you cannot apply for the adoption visa.
  5. The adoption must be supported by a State or Territory welfare authority.  The only exception to this arises when the adoptive parent(s) have lived overseas for at least 12 months at the time of visa application.  Such parent must be able to demonstrate that they did not live overseas for this length of time to deliberately bypass the requirements concerning entry of adopted children.
