The criteria for Australia's Migration Program is selective, choosing only those applicants who meet Australia's requirements and have good prospects for successful settlement.

Migrants can be selected on the basis of such factors as relationship to an Australian permanent resident or citizen, skills, age, qualifications, capital and business acumen.

All applicants must also meet the health and character requirements specified by migration legislation.

There are detailed rules governing entry in each migration category and selection is based on the case-by-case assessment of applications.

Skilled stream categories

The Skill Stream of Australia's Migration Program is specifically designed to target migrants who have skills or outstanding abilities that will contribute to the Australian economy.

The Australian Government continues to emphasise skilled migration, while maintaining a commitment to family reunion migration. The migration to Australia of people with qualifications and relevant work experience helps to address specific skill shortages in Australia and enhances the size and skill level of the Australian labour force.

The Skill Stream planning level for 2007–08 is 108 500, with a continued emphasis on:

  • employer sponsored migration
  • state/territory government sponsored applications
  • applicants who nominate an occupation which is on the Migration Occupations in Demand List (MODL).

Family stream categories

Family stream migrants are selected on the basis of their family relationship with their sponsor in Australia. There is no test for skills or language ability as for skilled stream migrants.

The family stream has four main categories:

Partner

  • Spouse: the husband, wife or de facto partner of the Australian sponsor
  • Prospective Marriage: a fiancé overseas who plans to marry their Australian sponsor after travelling to Australia
  • Interdependency: a person in an interdependent relationship with an Australian partner involving a mutual commitment to a shared life together.

Temporary stream categories

People may enter Australia on a temporary basis, whether as visitors, students or for a range of specialised purposes under the temporary residence program.

Temporary entrants include:

  • tourists
  • students
  • business people for short stays
  • people with specialist skills, such as managers, academics and medical practitioners
  • people who make a social or cultural contribution to the community, such as entertainers, media and film staff, sports people, religious workers, visiting academics and
  • people who contribute to the development of international relations, such as diplomatic personnel, participants in exchange programs and working holiday makers.
